Focus Pointe Global Sweepstakes Official Rules

1.   Introduction:  The Focus Pointe Global Monthly Sweepstakes (the "Sweepstakes") is presented in conjunction with the Focus Pointe Global Online Survey Program ("Program").  The Terms and Conditions of the Focus Pointe Global Online Survey Program may be found here.

2. Eligibility:  The Focus Pointe Global Monthly Sweepstakes (the “Promotion”) is open only to registered participants in good standing  of the Focus Pointe Global survey panel who are legal residents of the 50 United States and the District of Columbia, 13 years of age or older and located in the U.S. at the time of entry (“Participants”). The information in the survey, if applicable, must be authentic, relevant to the study and meet any criteria established by Focus Pointe Global for the survey applicants.  Employees, contractors, directors and officers of Focus Pointe Global (“Sponsor”) and their respective parents, subsidiaries and affiliated companies, distributors, licensees and the advertising, fulfillment, judging and promotion agencies involved in the development and administration of this Promotion (collectively, “Promotion Parties”), and their immediate family members (parent, child, sibling and spouse of each) and those living in the same households of each are not eligible. Void elsewhere and where prohibited by law.

3.   How to Enter:   There are two ways to enter (collectively “Sweepstakes Entries”):
a.  Online Entry. Receive an entry into the applicable Monthly Sweepstakes (as defined below) for each survey you complete during the applicable month (a “Completion Entry").  Some surveys may permit entry into the Monthly Sweepstakes to Participants that start the survey but do not qualify to complete the survey (e.g., when the survey is terminated by Sponsor) (a “Termination Entry”).  If completion of the survey is required for online entry, the survey email invitation will so state.  Some surveys may offer more than one entry for completing or terminating the survey, as announced in the survey email invitation.  Completion Entries and Termination Entries are collectively “Online Entries”         
b.  Mail-in Entry. If upon receipt of an invitation to answer a survey, Participant elects not to complete the survey, Participant may enter the Sweepstakes by writing his/her first and last name, complete mailing address, daytime telephone number, date of birth, email address, and the date and complete URL address to the survey for which Participant was selected on a 3 x 5 inch (or 7.5 x12.5 cm) card and mail it in an envelope to:

Mail-in Participants will receive the same number of entries as if the survey had been completed.  For each survey, you may only enter once via Online Entry or via Mail-in Entry, not both.  You may only take each survey once, but you will receive the number of entries associated with each survey completed for the applicable Monthly Drawing. 
4.   Monthly Sweepstakes Drawings: Sponsor will conduct monthly drawings from among all eligible entries received during each calendar month (a “Monthly Sweepstakes”). A “calendar month” begins at 12:00:01 a.m.  Eastern Time ("ET") on the first day of each calendar month and ends at 11:59:59 p.m. ET on the last day of each calendar month ("Entry Period").  After each monthly Entry Period, on or about the 10th day of each month following the close of the previous month's Entry Period, Sponsor will select winners at random.  If no eligible entries are received within a calendar month, a random sweepstakes drawing will not be conducted for that month. All decisions are final and binding.  The odds of winning depend on the number of eligible entries received from all Online Entries and Mail-in Entries during the relevant Entry Period.  Each drawing is conducted separately; no entries are carried over to subsequent drawings. Sponsor reserves the right to terminate the Monthly Sweepstakes at any time after the then current Entry Period.

5.   Prizes, Approximate Retail Value (“ARV”) & Odds: One (1) Grand Prize: $250 to be paid by check. One (1) First Prize: $100 to be paid by check. One Second Prize: $50 to be paid by check and Four (4) Third Prizes: $25 to be paid by check. Total ARV of all prizes is $500. Prize value will be credited to the Winner’s account to be redeemed by check at Winner’s discretion. No substitution or transfer of prizes is permitted except at Sponsor’s sole discretion. All federal, state and local taxes are the sole responsibility of the winner.  Delivery of prizes will be performed after winner validation.  LIMIT ONE (1) PRIZE PER PERSON/EMAIL ADDRESS/HOUSEHOLD PER MONTH. Odds of winning any prize depend on the number of entries received. At the Sponsor’s discretion, unclaimed prizes may not be awarded.

6.   General Rules:  All federal, state and local laws apply.  Winners must complete the check request process in the Member section of the Focus Pointe Global panel in order to receive their prize.  Winners will be notified by email, mail or telephone. Potential winners (or potential winners' parent or legal guardian if potential winner is a minor) may be required to sign and return an Affidavit of Eligibility and Release of Liability and a Publicity Release within ten (10) days of attempted delivery or prize will be forfeited.  The return of any prize/prize notification as undeliverable or failure to respond to notices or return any documents in a timely manner, as determined by the Sponsor, may result in disqualification and an alternate winner may be chosen.  By participating, participants agree to release, discharge and hold harmless Promotion Parties from and against any and all liability or damages associated with this Promotion or acceptance of any prize received in this Promotion.  Promotion Parties are not responsible for any typographical or other error in the printing of the offer or administration of the Promotion.  Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners’ names and likenesses for purposes of advertising and publicity without further compensation, unless prohibited by law.  By participating in this Promotion, participants agree to be bound by the Official Rules and decisions of the Sponsor, which shall be final in all matters relating to the Promotion.  Promotion Parties are not responsible for lost, late, misdirected, stolen, illegible, inaccurate, damaged, incomplete, non-delivered or postage-due mail; or for printing, distribution or production errors or for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Promotion, or by any human, or other error, which may occur in this Promotion.  If, in the Sponsor's sole opinion, there is any suspected or actual evidence of tampering with any portion of the Promotion or if technical difficulties compromise the integrity of the Promotion, Sponsor reserves the right to void suspect entries and/or modify and/or terminate the Promotion and/or conduct a random drawing to award the prizes using all known eligible non-suspect entries received. In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared to the registered Participant whose name and validated mailing address matches the email address having received the survey invitation via email. The “registered Participant” is defined as the name of the person that registered the email address with the Focus Pointe Global panel. Sponsor reserves the right to disqualify any individual who tampers with the Promotion or Website or acts in a disruptive manner. This Promotion is offered only in the United States and is governed by the laws of the State of Pennsylvania. By entering, entrants irrevocably consent to the sole and exclusive jurisdiction of the courts of the State of Pennsylvania located in the county of Philadelphia for any action, suit or proceeding arising out of or relating to this Promotion.

7.   Waiver: By participating in this Promotion, participant waives all rights to claim punitive, incidental and consequential damages, attorneys’ fees or any damages other than actual out-of-pocket costs incurred to participate. 8.   Winners’ List: To receive a copy of the Winners’ List for this Promotion, send your request (identifying the specific monthly Entry Period) along with a self-addressed stamped envelope to:
